¶1Supplementary Affidavit filed by the petitioner is taken on record. Latches in filing writ petition as explained in the supplementary affidavit is accepted.

¶2The present petition has been filed challenging the auction notice dated 20.09.2019 for sale of the mortgage land of the petitioner, which was put as security for the loan advanced.

¶3The petitioner disputes the loan amount shown in the auction notice and also states that he is ready to pay the actual dues. In this regard, the petitioner has submitted representation before the Branch Manager, Uttar Pradesh Sahkari Gram Vikas Bank, Jamaniya, Ghazaipur which is the bank from which the petitioner has taken loan.

¶4It would serve no purpose to keep the writ petition pending.

¶5The writ petition is disposed of with the liberty to the petitioner to file a fresh representation before the Branch Manager, Uttar Pradesh Sahkari Gram Vikas Bank, Jamaniya, Ghazaipur i.e. respondent no. 3 who shall pass a reasoned order on the same within a period of 3 months from the date of filing the representation and take appropriate action in accordance with law.
