This petition has been filed with a prayer to quash the first information report registered as Case Crime No.116 of 2023. The allegations in the FIR is with regard to demand of dowry and cruelty to the wife. Contention is that petitioner is the son of jeth and his implication in the matter is false. We have perused the FIR, which prima facie discloses commissioning of cognizable offence. What exactly is the role of the petitioner is an aspect to be determined at the stage of investigation/trial. Husband and other family members implicated in the FIR have not been arrayed as a party. We would not be justified in examining the individual role of the petitioner so as to quash the FIR. Leaving all issues open for determination in appropriate proceedings instituted under the Code of Criminal Procedure, this petition is consigned to records.
