Applicant being accused has approached this Court through this application under Section 482 Code of Criminal Procedure seeking quashing of the impugned order dated 04.10.2023 passed by Additional Session Judge, Court No.5, Mau, District-Mau in Session Case No.675 of 2023, titled State of U.P. Vs. Ashwani Yadav, arising out of Case Crime No.272 of 2022, under Sections 304, 201 I.P.C, Police Station-Haldharpur, District-Mau. When confronted with the maintainability of the petition under Section 482 Code of Criminal Procedure, as the impugned order dated 04.10.2023, discharging the accused upon considering the final report under Section 173(2) Code of Criminal Procedure, is revisable, learned counsel prays for the withdrawal of this petition to avail the statutory remedy.
