Judgment

Court No. - 40 Case :- WRIT - C No. - 37112 of 2023 Petitioner :- Pintu Prajapati Respondent :- State Of U.P. And 3 Others Counsel for Petitioner :- Praveen Kumar Singh Counsel for Respondent :- C.S.C. Hon'ble Mahesh Chandra Tripathi,J. Hon'ble Ram Manohar Narayan Mishra,J.

¶1Heard Shri Praveen Kumar Singh, learned counsel for the petitioner and Shri Ambrish Shukla, learned Additional Chief Standing Counsel for the State respondents.

¶2Pintu Prajapati s/o late Shiv Shankar Prajapati has approached to this Court with a grievance that till date in view of the Government Order dated 28.02.2020, which was issued for providing compensation under Mukhyamantri Krishak Durghatana Kalyan Yojna, benefit has not been extended to the petitioner.

¶3It is submitted that father of petitioner died on 27.04.2022 in an accident. The petitioner has submitted his claim on 30.05.2022 before the District Magistrate, Prayagraj to extend benefit under Mukhyamantri Krishak Durghata Yojana. The same was duly endorsed by the Area Lekhpal on 09.05.2023. On the said application only objection was raised that 'No Objection Certificate' (in short 'NOC') was not accorded by the real brother of petitioner. In support of his submission, learned counsel for the petitioner has placed reliance on the notarized affidavit (appended as Annexure no.7 to the writ petition) and submits that the real brother of petitioner has accorded his NOC and as such, the respondents may extend benefit in favour of the petitioner.

¶4Shri Ambrish Shukla, learned Additional Chief Standing Counsel fairly states that in case the proceeding is still pending consideration, definitely the same would be finalised expeditiously.

¶5Considering the facts and circumstances, we are not inclined to keeping the matter pending consideration. The writ petition is disposed of asking the District Magistrate, Prayagraj/District Level Authority to look into the grievance of the petitioner and take a final in the matter to process the application in accordance with law. Needless to say that we have not adverted on the merits of the case. Order Date :- 8.12.2023 A. Pandey High Court of Judicature at Allahabad
