¶1Heard learned counsel for the petitioner.

¶2In view of the order proposed to be passed, notices need not go to the private respondents.

¶3Counsel for the petitioner has confined his prayer only to the effect to direct the Civil Judge (J.D.), Mauranipur, Jhansi to decide the application for temporary injunction being Paper No.21-C-2 filed in Original Suit No.277 of 2022 (Hemant Barsaiya Vs. Kailash Barsaiya & others)

¶4It is argued by counsel for the petitioner that next date fixed in the matter is 20.12.2023.

¶5Considering the facts and circumstances of the case, without expressing any opinion on the merits of the issue, the present petition stands disposed of finally with a direction to the court below to consider and decide the aforesaid application strictly in accordance with law on the next date fixed in the matter after hearing all the parties concerned. If on account of any reason no orders were passed on the aforesaid date, the decision will be taken on the aforesaid application preferably within a period of three weeks from the next date fixed in the matter, thereafter, if there is no legal impediment.
