¶1Heard learned counsel for the petitioners.

¶2In view of the order proposed to be passed, notices need not issue to the private respondents.

¶3After some arguments, a prayer has been made by the counsel for the petitioners to direct the court below to decide the Paper No. 6C filed under Order 39 Rule 1 and 2 of C.P.C. filed in Original Suit No.2401 of 2023 (Shailendra Kumar Maurya and others vs. Manoj Kumar Maurya and others) within stipulated period.

¶4Considering the facts and circumstances of the case, without expressing any opinion on the merits of the issue, the present petition stands disposed of finally with a direction to the court below to consider and decide the aforesaid application in accordance with law on the next date fixed in the matter after hearing all the parties concerned. If on account of any reason no orders were passed on the aforesaid date, the decision will be taken on the aforesaid application preferably within a period of three weeks, thereafter.
