¶1The matter is listed before the National Lok Adalat. The parties have agreed upon settlement of this Appeal/FAFO on the following terms and conditions:-

i) The claimants/appellant shall be entitled to get Rs.11,43,470/- (Rupees Eleven Lakh Forty Three Thousand Four Hundred and Seventy only) over and above the amount already paid in full and final satisfaction of their claim from Respondent-Insurance Company.

ii) The Insurance company shall not pay any interest on the compromised/settled amount.

iii) The amount of Rs.25,000/- deposited by appellant-Insurance Company under Section 173 of Motor Vehicles Act shall be refunded to the appellant.

iv) The amount due as above shall be deposited/paid through cheque within 60 days from the date of receipt of copy of the order of the Hon'ble Court, failing which interest @ 6% per annum shall accrue from such date till payment. That the parties have compromised the appeal out of their free consent and without any coercion/pressure of any kind. In view of above, appeal stands disposed of in terms of the aforesaid compromise.
