¶1Heard Shri Bashisth Narain pandey, Counsel for the petitioner, Mr. Rajesh Kumar Dwivedi, learned State Officer for the State - respondents and Mr. Bhupendra Kumar Tripathi, learned counsel for respondent No.3 - Gaon Sabha.

¶2The instant writ petition has been filed praying for a mandamus directing respondent No.2 - Tehsildar/Assistant Collector, Tehsil - Machhlishahar, District - Jaunpur to decide the Case No.02660 of 2020 being Computerized Case No. T202014360302660 (Revenue Lekhpal Vs. Jai Prakash), u/s 67 of the U.P. Revenue Code, 2006, within stipulated period.

¶3Counsel for the petitioner submitted that proceeding under Section 67(1) of the U.P. Revenue Code, 2006 is pending since 24.6.2020 for adjudication.

¶4Copy of the order sheet has been annexed as Annexure No.4 to the writ petition in order to demonstrate that the case is not proceeding expeditiously.

¶5Considering the entire facts and circumstances of the case, the instant public interest litigation is finally disposed of with a direction to respondent No.2 - Tehsildar/Assistant Collector, Tehsil - Machhlishahar, District - Jaunpur to consider and decide the aforementioned case, in accordance with law, expeditiously and preferably within a period of three months from the date of production of certified copy of this order after giving opportunity of hearing to the parties concerned and without granting unnecessary adjournments to either of the parties.
