¶1Heard learned counsel for the applicant, learned A.G.A. for the State and perused the material brought on record.

¶2The present bail cancellation application moved on behalf of the applicant with prayer to cancel the bail granted to the opposite party no.2, by the Session Judge, Etah, in Bail Application No.3002 of 2023 (Rohtas Vs. State of U.P., vide order dated

12.10.2023, in Case Crime No.217 of 2023, under sections 147, 148, 149, 323, 504, 307, IPC, Police Station Bagwala, District Etah.

¶3Considering the facts that opposite party no.2 was released on bail by the Session Court. No opportunity has been availed by the applicant for cancellation of bail in the court concerned and directly moved the present bail canellation application before this Court.

¶4In the aforesaid circumstances, present application for cancellation of bail granted to opposite party no.2 is hereby rejected with the direction to the Session Court concerned, that if the applicant move an application for cancellation of bail granted to the opposite party no.2, same shall be consider by the court concerned and decide in accordance with law.
