Applicant-Raj Kumar Jaiswal has approached this Court through this application under Section 482 Code of Criminal Procedure for issuance of directions to the Additional Chief Judicial Magistrate/ Civil Judge (S.D.)/ F.T.C., Kushinagar to expeditiously decide the Compliant Case No. 16712 of 2023, titled Raj Kumar Jaiswal Vs. Sandeep Jaiswal and others, under Section 156(3) Cr.P.C., Police Station Hanumanganj, District Kushingar in a stipulated period. Concededly, the complaint has been treated and the procedure contemplated by Chapter XV Cr.P.C. has been adopted by the Magistrate only on 20.7.2023 and thereafter, the case was taken up on three occasions, and adjourned for recording the statement under Section 200 Cr.P.C. There is nothing on record to indicate that despite the presence of the complainant, his statement has not been recorded, therefore, no case is made out for issuance of any direction for expeditious disposal of the complaint.
