¶1Heard learned counsel for the parties and perused the record.

¶2In view of the order proposed to be passed today, notices need not be issued to the private respondents no. 5 to 10.

¶3In pith and substance, the grievance of the petitioners is that the respondent nos.5 to 10 are interfereing in the peaceful possession of the petitioner over Gata No. 498, situated at Gram Sonauti, Tehsil Phoolpur, District Prayagraj. It is stated that petitioner has already approached the authorities concerned raising his grievance, but till date no action has been taken.

¶4Learned Standing Counsel fairly submitted that in case, petitioner moves a representation before the concerned Sub Divisional Magistrate raising his grievances, the same would be considered and decided by the concerned authority within the time as fixed by this Court.

¶5Considering the facts and circumstances, without adverting any opinion on the merits of the case, we dispose of the writ petition requiring the petitioner to file a fresh representation ventilating his grievances before the concerned Sub Divisional Magistrate within ten days from today along with a certified copy of this order and in case, such representation is filed, the concerned Sub Divisional Magistrate shall consider and decide the same in accordance with law, as expeditiously as possible, preferably within three weeks thereafter, but certainly after affording opportunity to all the stakeholders in the matter.
