Judgment
Court No. - 81 Case :- HABEAS CORPUS WRIT PETITION No. - 979 of 2023 Petitioner :- Era And 2 Others Respondent :- The State Of U.P. And 5 Others Counsel for Petitioner :- Rajesh Kumar Mishra Counsel for Respondent :- G.A. Hon'ble Mrs. Jyotsna Sharma,J.
¶1Heard Sri Rajesh Kumar Mishra, learned counsel for the petitioners and Sri L.D. Rajbhar, learned AGA for the State.
¶2This petition has been filed by the cousin of the corpus petitioner nos. 1 and 2 namely, Era and Babi Aashi, who are said to be aged about 18 years and 17 years. In para no. 7, it is said that a third daughter Era was born to respondent no. 6 in 2006.
¶3This petition has been filed against private respondent no. 6, who is said to be the mother of the corpus. The petitioner no. 3-Mushir Ahmad Siddiqui has failed to disclose his relationship with the petitioner nos. 1 and 2. The petitioner has made some vague statements which do not make out any sense. He has not disclosed any good reason for filing this habeas corpus writ petition and has not been able to clarify what is his locus standi in filing this petition against the mother of the corpus(s).
¶4In view of the above, I do not find any good reason to proceed in this habeas corpus writ petition. It is observed that if the petitioner no. 3 suspect any foul play with two daughters of respondent no. 6, he may take recourse to legal action/remedy as provided in law instead of filing this misconceived habeas corpus writ petition. I do not find any good ground to proceed further in this petition, hence it is dismissed. Order Date :- 11.12.2023 #Vikram/- High Court of Judicature at Allahabad
