Ms. Pooja Singh, Advocate raises a preliminary objection regarding maintainability of the writ petition and states that against the impugned order, petitioners have alternative efficacious remedy of appeal. Confronted with the said fact, learned counsel for the petitioner submits that an appeal has already been preferred, which is pending but he could not satisfy the Court that when the appeal is pending as to how, the present petition is maintainable. In view of above, the writ petition is dismissed on the ground of that two proceedings on the same cause of action cannot go together.
