Judgment
Court No. - 81 Case :- HABEAS CORPUS WRIT PETITION No. - 982 of 2023 Petitioner :- Khushi Yadav And Another Respondent :- State Of U.P. And 3 Others Counsel for Petitioner :- R.K.Paramhans Singh Counsel for Respondent :- G.A. Hon'ble Mrs. Jyotsna Sharma,J.
¶1Heard Sri R.K.Paramhans Singh, learned counsel for the petitioners and Sri R.K. Gupta, learned AGA for the State.
¶2This habeas corpus writ petition has been filed by the petitioner no. 2-Ravindra Rajbhar with the contention that the petitioner no. 1-Khushi Yadav is his legally wedded wife, the marriage being solemnized in September 2023.
¶3It is contended on his behalf that the corpus is about 20 years old and she tied marital knot with petitioner no. 2 out of her own free will. The respondent no. 4 (father of his wife) was not happy with this marriage, therefore, on a false pretext his wife was taken away by her father and forced to marry another person.
¶4It is submitted by the learned AGA that the girl herself lodged an FIR case crime no. 0213 of 2023 under section 366 IPC against petitioner no. 2-Ravindra Rajbhar and that she has, in her statement under section 161 Cr.P.C., imputed allegations against him and a chargesheet no. 154 of 2023 under sections 366 and 376 IPC has been submitted on 03.07.2023.
¶5As the matter has been seized by the court concerned and admittedly the girl was staying with respondent no. 4 (her real father), I do not find any good reason to proceed in this habeas corpus writ petition, hence the petition is dismissed.
