¶1In compliance of our order dated 29.11.2023, Sri Nitin Ramesh Gokarn, Additional Chief Secretary, Housing and Urban Planning Department, Lucknow has filed his affidavit stating that a circular letter has been issued on 06.12.2023 addressed to the Commissioner, U.P. Avas Evam Vikas Parishad, Lucknow, President of Special Area Development Authorities, U.P., Vice Chairman of the Development Authorities and District Magistrate/Controlling Authority of Regulated Area, U.P. to ensure compliance of the order of Supreme Court dated 28.04.2023 passed in Civil Appeal No. 5645 of 2015 (Mathura Vrindavan Development Authority and Another Vs. Rajesh Sharma and Others).

¶2Sri D.S. Chauhan, learned counsel appearing for Mathura Vrindavan Development Authority states that the impugned demand notice has been withdrawn and modified demand notice has been issued. According to him, charges held to be not permissible by the Supreme Court have now been withdrawn.

¶3Learned counsel for the petitioner fairly states that the cause of action does not survive.
