1.Heard Counsel for the petitioner, Mr. Abhishek Shukla, learned Additional Chief Standing Counsel for the State-respondents and Mr. Sudhir Bharti, learned counsel for respondent No.4/Gram Sabha.

2.The instant writ petition has been filed for the following relief: "(i) issue a writ, order or direction in the nature of mandamus directing the respondents not to construct the overhead water tank at arazi no. 107 and 108 which ware recorded as play ground and khalihan respectively in the revenue records and construct the said over head water tank on any other land recorded in Abadi or Banjar khata of Village Rawat Dadi,Tehsil-Khajani, District-Gorkahpur."

¶3In compliance of the earlier order of this Court, instruction dated 06.12.2023 is filed before this Court, is taken on record.

¶4Mr. Abhishek Shukla, learned Additional Chief Standing Counsel for the State-respondents and Mr. Sudhir Bharti, learned counsel for respondent No.4/Gram Sabha on the basis of instruction submitted that earlier Writ C No. 31591 of 2023 was filed by Om Prakash Yadav in respect to the construction of water tank under the Government Scheme on the ground that authorities are encroaching the plot Nos. 106 and 107. He further submitted that writ petition be disposed of with the direction to decide the pending proceeding under Section 34 of U.P. Revenue Code, 2006 in accordance with law. He further submitted that petitioner is brother of Om Prakash Yadav, who has filed the instant Public Interest Litigation. He further submitted that instant Public Interest Litigation cannot be entertained to settle the private interest of the petitioner. He further submitted the even on merit water tank has been proposed to be constructed over plot No.107 and 108 in the interest of villagers of the village but petitioner has come before this Court by way of Public Interest of Litigation against the scheme of the Government as such the instant public interest ligation be dismissed with cost against the petitioner.

¶5I have considered the arguments advanced by learned counsel for the parties and perused the record.

¶6There is no dispute about the fact that plot Nos. 107 and 108 are recorded as public utility land in the revenue record. There is also no dispute about the fact that Government is constructing water tank under the Scheme of Government. There is no dispute about the fact that earlier Writ C No. 31591 of 2023 has been filed by the brother of the petitioner. The facts mentioned in the instruction dated 06.12.2023 is relevant for the perusal, which is as under: "

¶7Perusal of the instruction reveals that the instant public interest litigation filed on behalf of petitioner cannot be entertained as the same has been filed with malafide intention.
