The present petition has been filed praying for a mandamus commanding the private respondent nos. 2 and 3 to remove the encroachments over the plot no.585, which the petitioner claims to be his private property. The issue in the present petition involves disputed question of facts regarding title and possession of the parties and, therefore, it is not a case for consideration under Article 226 of the Constitution of India. The petitioner may seek appropriate remedy either before Civil Court or if so advised before the revenue court. The petition is dismissed.
