¶1The present appeal has been preferred against the order dated

14.07.2023 passed by Additional Principal Judge, Family Court, Room No. 1, Kanpur Nagar, in Divorce Petition No. 250 of 2019 (Ramadhar vs. Smt. Rajrani).

¶2The appeal is defective being barred by limitation. While application has been filed seeking condonation of delay, learned counsel for the appellant fairly states that the appellant has a remedy of filing a recall application and he prays that the present appeal may be dismissed as withdrawn with liberty to avail remedy under Order 9 Rule 13 CPC.
