The grievance of the petitioner in the present petition is that certain persons have encroached over the land, which the petitioner inherited. It appears from the averments made in Paragraph no.7 of the writ petition that the encroachment is because the boundaries of plot nos.28 and 29 are being shifted in plot no.26, which the petitioner claims to be his bhumidhari plot. It has also been stated in Paragraph no.9 of the writ petition that the petitioner has already instituted suit before the Sub-Divisional Magistrate, District-Baghpat in the year 2022. Petitioner has also a remedy to file an application under Section 24 Uttar Pradesh Revenue Code, 2006 for demarcation. However as alternative legal proceedings has already been instituted by the petitioner, therefore, it is not a case to interfere under Article 226 of the Constitution of India.
