Heard learned counsel for the petitioner and learned Standing Counsel for State. At present, the petitioner is only pressing prayer no. (ii), which is quoted hereunder:- "(ii) issue a writ, order or direction in the nature of mandamus commanding the respondent Debt Recovery Tribunal, Lucknow to decide the S.A. No. 838 of 2023, within specific period as fixed by this Hon'ble Court." Learned counsel for the petitioner states that his S.A. Case No. 838 of 2023 is pending and same may be decided within the stipulated period as fixed by this Court. The learned Standing Counsel has no objection to the said prayer. No useful purpose would be served by keeping this petition pending in view of the order, which the Court proposes to pass hereunder. Without entering into the controversy involved in the writ petition, the writ petition is disposed of with direction to Debt Recovery Tribunal, Lucknow to decide the S.A. No. 838 of 2023, expeditiously, after hearing the parties concerned, in accordance with law provided there is no other legal impediment.
