The grievance of the petitioner in the present petition is that regarding payment of Rs. 15,15,748/- along with suitable interest in pursuance to the contract executed by the petitioner at the instance of the respondents. It is stated in the petition that amount is not disputed by the respondents. No document has been annexed with the writ petition showing that the dues payable to the petitioner are admitted by the respondents. The issue raised in the present petition can also be decided by the Executive Engineer, Drainage Control, District Gorakhpur i.e. respondent no.2. The petition is disposed of with the liberty to the petitioner to file a representation before the Executive Engineer, Drainage Control, District Gorakhpur who shall decide the said representation within a period of three months from the date of filing the same and in case, any dues are payable to the petitioner, the same shall be paid within a period of two months from the date of decision on the representation.
