Hon'ble Vikram D. Chauhan,J. Heard learned counsel for the appellant and learned A.G.A. for the State. At the very outset, learned counsel for the appellant states that he may be permitted to withdraw the present appeal with liberty to file a bail application before the court concerned. Learned A.G.A. has no objection to the prayer made by learned counsel for the appellant. Considering the prayer made by learned counsel for the appellant, the present appeal is dismissed as withdrawn with liberty to file bail application before the court concerned along with the surrender application. In the event, the appellant files the surrender application and bail application within ten days' from today, the court concerned shall obtain instructions from the prosecution in this respect and fix a date and thereafter, the surrender application and bail application shall be decided on the same day, if possible.
