¶2Learned counsel for both the sides are present.

¶3This Court taking notice of filing of Appeal No.1 of 2023 against the impugned order, adjourned the matter granting time to the learned counsel for the petitioner to address the Court on the aforesaid issue.

¶4Learned counsel for the petitioner submits that he does not want to press the present writ petition, however, he does not dispute that the appeal has already been decided.

¶5Shri S.K. Chaturvedi, learned counsel for the respondents submits that appeal has been allowed on 01.11.2023.

¶6In view of the above, learned counsel for the petitioner requests the Court to dismiss the writ petition as not pressed with liberty to avail appropriate proceedings in respect of any subsequent cause of action.
