¶1Heard learned counsel for the petitioner and learned standing counsel for the State-respondents.

¶2This writ petition is preferred for a direction in the nature of mandamus directing the respondent No.2 - Divisional Level Review Committee, Headed by Commissioner, Gorakhpur Division, Gorakhpur to decide the appeal dated 12.09.2023 along with stay application preferred by petitioner against the order dated

21.08.2023 passed by respondent No.3 - District Level Review Committee, Headed by District Magistrate, Deoria, within stipulated period.

¶3Considering the facts and circumstances of the case, no useful purpose will be served to keep this petition pending and call for a counter affidavit.

¶4In view of the aforesaid and without expressing any opinion on the merits of the case, this petition is disposed of directing the respondent No.2 to decide the aforesaid appeal in accordance with law, expeditiously preferably within thirty days from the date of presentation of a certified copy of this order, after affording reasonable opportunity of hearing to all the parties concerned.
