¶1Heard learned counsel for the petitioner as well as learned AGA appearing for the respondents and have perused the record.

¶2Present petition has been filed with a prayer to direct the respondent no. 2 to decide the stay application filed by the petitioner on 25.7.2023 in Appeal No. 1211 of 2023 and Computer Case No. C-202305000001211 (State vs. Khushiyal @ Indrajeet Chauhan) within stipulated time period which is fixed by this Hon'ble Court.

¶3In the facts and circumstances of this case, present petition stands disposed of with a direction to the respondent no. 2-Commissioner, Gorakhpur Division, Gorakhpur to hear and decide the said appeal of the petitioner, in accordance with law by reasoned and speaking order, as expeditiously as possible, preferably within a period of one month from the date of filing of a certified copy of this order before the respondent no. 2.
