Parties have arrived at a compromise. The appellant undertakes to pay a sum of Rs.52,92,160/-. The appellant and the respondent have agreed that the appellant shall pay a sum of Rs.52,92,160/- minus Rs.11,16,078/- which has already been paid (towards full and final settlement of the claims made by the respondent against the appellant). The respondent shall not make any further claim apart from that which is part of this compromise. The joint affidavit shall also be filed parties to this effect. The appellant to deposit the amount of Rs.41,76,082/- by RTGS transfer in the bank account of the respondent within a period of five working days. The amount deposited by the appellant i.e. Rs.11,16,078/- with the Registrar General of this Court shall be refunded to the former along with the accrued interest within a period of two weeks. Shri Rohan Gupta, learned counsel for the appellant and Shri Syed Safdar Ali Kazmi mediated with the litigants to ensure that the parties are reached a just solution in an amicable manner. The learned counsels have acted in a manner commensurate with the high traditions of the profession. Appeal is disposed in terms of the compromise.
