¶1Heard learned counsel for the petitioner and Sri Prashant Singh, State Law Officer for State-respondents.

¶2The present writ petition has been preferred for a mandamus commanding Land Conservation Officer, Irrigation and Water Resources Department, Shahjahanpur to ensure compliance of order dated 26.8.2021 and further prayer has been made for commanding District Magistrate, Shahjahanpur to decide representation dated 13.8.2021 filed by the petitioner.

¶3Learned counsel for the petitioner in support of his submission submitted that complaint of the petitioner was entertained way back in 2021 and Land Conservation Officer, Irrigation and Water Resources Department, Shahjahanpur has already passed an order on 26.8.2021. He has confined his prayer that till date the said order has not been complied with.

¶4Learned counsel for the State-respondents submitted that in case the aforesaid order passed by the respondent authority has not been complied with, the same would be complied with expeditiously.

¶5Considering the facts and circumstances, we are not inclined to keep the matter pending consideration and dispose of the present writ petition asking District Magistrate, Shahjahanpur to take final call but certainly taking into account the report submitted by the Sinchpal on 21.8.2021 and after affording opportunity of hearing to all the stakeholders in the matter.
