¶1The instant petition has been filed in public interest for a writ of mandamus commanding respondent nos.2 to 7 to stop / seal ongoing construction of hospital over residential plot in violation of the demolition order already passed on 31.08.2021 under Section 27(1) of the U.P. Urban Planning and Development Act, 1973.

¶2Sri Ravi Prakash Pandey, learned counsel appearing for Varanasi Development Authority, on instructions, states that the owner of the building has filed an appeal before the Commissioner and it is pending. He further states that offending constructions have once again been sealed.

¶3Having regard to the aforesaid facts, we are of the opinion that no direction is required to be issued at this stage.
