This petition is a defendant's petition seeking the following relief: "(i) issue a order to direct to the learned Civil Judge (J/D), Varanasi to decide the original suit no. 790 of 1998 (Mohd. Hanif and others Vs. Rabiya and others), pending before the court of the learned Civil Judge (J/D), Varanasi, within stipulated period fixed by this Hon'ble Court." When the matter was last listed on 5.10.2023, this Court has sought a report from the District Judge, Varanasi. The office in its report of 25.10.2023 has referred to a report from the District & Sessions Judge, Varanasi which has been placed on record. A perusal of the report of the District Judge dated 19.10.2023 reflects that 18.10.2023 was fixed for cross-examination of the D.W.-1. He has further informed that the Presiding Officer of the court of the Additional Civil Judge (Junior Division), Court No. 10 has been instructed to decide the case expeditiously and if possible on a day to day basis.
