On the matter being taken up, Mr. Sanjay Singh, learned counsel for opposite party no. 2 pointed out that during pendency of this application under Section 482 Cr.P.C., the discharge application being application no. 9B under Section 227 Cr.P.C. of the applicants has been dismissed vide order dated 22.11.2023 by the trial Court but the said fact has not been brought on record by the applicants. In response, learned counsel for the applicants could not dispute the said fact and submits that the applicants do not want to press this application, therefore, they may be allowed to withdraw this application with liberty to file fresh application with better particulars. In view of the statement made by Mr. Sarvesh Kumar Singh, learned counsel for the applicants at the bar, instant application is dismissed as withdrawn with liberty as prayed for. OfÏce is directed to return certified copy of the document, if any, after retaining the xerox copy of the same, to learned counsel for the applicants within three days.
