The grievance of the petitioner in the present petition is that the State respondents are constructing a water tank on the bhumidhari Plot No. 48 of the petitioner. The dispute can be decided by an inspection of the spot by the revenue authorities and, therefore, the writ petition is disposed of with the liberty to the petitioner to file a representation before the District Magistrate, District Basti bringing all the necessary facts to his notice who on receipt of the said representation shall decide the same, in accordance with law, within a period of one month from the date of receiving the representation. If necessary, the District Magistrate shall get the plot demarcated and inspected. With the aforesaid direction, the writ petition is disposed of.
