¶1The petitioner has challenged the demand notices dated

19.9.2023, 14.3.2023 and 16.4.2022 issued by respondent no.2 requiring the petitioner to deposit the remaining premium amount in respect of plot no. E-236, failing which the allotment of the plot would be cancelled.

¶2Learned counsel for the petitioner submits that in identical facts and circumstances, this Court has disposed of Writ C No. 40072 of 2023 by order dated 11.12.2023 providing the petitioner therein three months time to deposit the entire amount due along with interest, failing which it was left open to the authority to proceed further in the matter in accordance with law. He submits that identical order be passed in the instant case as the petitioner herein undertakes to deposit the entire defaulted amount along with interest within three months.

¶3Sri Jagannath Maurya, learned counsel appearing on behalf of respondent nos. 2 and 3 very fairly agrees to the aforesaid proposal.

¶4The operative part of the order of Writ C No. 40072 of 2023 is as follows: "5. The instant petition is disposed of by providing that the petitioner shall deposit the entire amount as demanded along with up to date interest within three months from today, failing which it shall be open to the authority to proceed in the matter in accordance with law."
