¶1Heard learned counsel for the parties.

¶2The grievance of the petitioners in the present writ petition is that the respondent no. 6 is illegally interfering in the peaceful possession of the petitioner over Plot No. 279 ad-measuring area 0.034 and also obstructing the petitioners from raising constructions over the plot.

¶3The issue raised in the writ petition is a disputed questions of fact regarding possession and title of the parties over the aforesaid plot which can be decided only on evidence and, therefore, the same is not cognizable by this Court under Article 226 of the Constitution of India.

¶4The petitioners may institute appropriate proceeding before the civil court for redressal of his grievance. The writ petition is not maintainable and is dismissed. Order Date :- 12.12.2023 Arif High Court of Judicature at Allahabad
