Heard learned counsel for the petitioner, counsel for the respondent no.3 and learned Standing Counsel for State. After hearing for sometime, learned counsel for the petitioner presses the prayer no.2, which reads as under:- "(ii) Issue writ order or direction in the nature of writ of ad interim Mandamus commanding to the respondent BSA to consider and pass appropriate final reasoned speaking orders on the representations of petitioners dated 04.10.2023 ensuring benefits of selection grade (ACP) permissible under the law with arrears and interest within reasonable time fixed by this Hon'ble Court." Learned counsel for the petitioner submits that the petitioner has moved a representation on 04.10.2023 and same may be decided within the stipulated time as fixed by this Hon'ble Court. Shri Suresh Kumar Maurya, counsel for respondent no.3 has no objection to the submission made by the counsel for the petitioner. No useful purpose would be served by keeping this petition pending in view of the order, which the Court proposes to pass hereunder. Without entering into the controversy involved in the writ petition, the writ petition is disposed of with direction to respondent no. 3 to decide the Representation dated 04.10.2023, expeditiously, preferably within a period of four months from the date of producing a certified copy of this order before the concerned authority, in accordance with law provided there is no other legal impediment. Learned counsel for the petitioner undertakes to serve the certified copy of this order along with fresh calculation and documents relied upon by the petitioner.
