By means of the present application under Section 483 Cr.P.C., the applicant has sought for a suitable direction to the learned Additional Chief Judicial Magistrate, Court No. 3, Gorakhpur to expedite the proceedings of Complaint Case No. 25342 of 2022 (Jamila Khatoon Vs. Mohd. Bablu Ansari & others) under Section 12 of Protection of Women from Domestic Violence Act, 2005, Police Station Pipraich, District Gorakhpur pending before learned Additional Chief Judicial Magistrate, Court No. 3, Gorakhpur within time stipulated by this Court. It was submitted by learned counsel for the applicant that applicant has filed a complaint under Section 12 of Protection of Women from Domestic Violence Act, 2005 in the year 2022 but the same has not been decided so far due to which, applicant is suffering irreparable loss. Learned counsel further submits that a direction may be issued to the concerned Court to decide the same within specific time. No useful purpose would be served in keeping the application pending, which is finally disposed off with a direction to learned Additional Chief Judicial Magistrate, Court No. 3, Gorakhpur to consider and decide the aforesaid case expeditiously, in accordance with law, preferably within a period of six months from the date of presentation of certified copy of this order, provided there is no other legal impediment.
