By means of the present application under Section 483 Cr.P.C., the applicant has sought for a suitable direction to the learned Additional Chief Judicial Magistrate, Court No. 2, Agra to decide Complaint Case No. 432 of 2022 (Man Singh Vs. Dileep Singh Jurail) under Section 138 N.I.Act, Police Station Achhnera, District Agra pending before learned Additional Chief Judicial Magistrate, Court No. 2, Agra within time stipulated by this Court. The perusal of the record goes to show that the summoning order dated 22.12.2022 was passed thereafter on the date fixed i.e on

23.01.2023, 04.03.2023, 09.05.2023, 16.06.2023, 26.07.2023 and

15.09.2023 the applicant/complainant was not present before the court. It appears that no steps were taken by him to ensure the appearance of respondent no. 2, therefore, the application under Section 483 Cr.P.C is devoid of merits and is liable to be dismissed.
