¶1Heard Mr. Shailesh Kumar Srivastava, learned counsel for the petitioner and Mr. Anand Bhaskar Srivastava, learned Standing Counsel for the State-respondents.

¶2In compliance of the order of this Court dated 31.10.2023, instruction dated 8.12.2023 is placed before the Court, which is taken on record.

¶3Mr. Anand Bhaskar Srivastava, learned Standing Counsel for the State-respondents on the basis of instruction dated

8.12.2023 submitted that the Sub-Divisional Officer, Soraon, Prayagraj has decided the proceedings under Section 24 of U.P. Revenue Code, 2006 vide order dated 2.12.2023. He further submitted that copy of the order dated 2.12.2023 is annexed along with the instruction dated 8.12.2023.

¶4Learned counsel for the petitioner submitted that the order dated 2.12.2023 passed by Sub-Divisional Officer is wholly illegal.

¶5Considering the facts and circumstances of the case as well as the order dated 2.12.2023 passed by Sub-Divisional Officer, under Section 24 of U.P. Revenue Code, 2006, no further cause of action survives in the matter.

¶6The writ petition is disposed of with liberty to the petitioner to initiate the proper proceedings against the order dated 2.12.2023 passed by Sub-Divisional Officer, Soraon, Prayagraj in accordance with law. Order Date :- 13.12.2023 Rameez High Court of Judicature at Allahabad
