The present transfer application has been filed to transfer the Criminal Revision No. 44 of 2023 (Arvind Kumar Gupta Vs. State and others) pending in the court of Sessions Judge Siddharthnagar to this Hon'ble High Court. Learned counsel for the applicants submits that two other criminal revisions are pending before this court as Criminal Revision No. 357 of 2023 and Criminal Revision No. 5321 of 2023. It is further submitted that Criminal Revision No. 44 of 2023, which is pending before the Sessions Judge, Siddharthnagar is similar in nature and against the same order. It is fairly admitted that the revisional court has power to recall all the cases related to pending case. In view of the above facts and circumstances of the case, the present transfer application has no merit and deserves to be dismissed. The present transfer application is dismissed accordingly.
