Judgment
Court No. - 39 Case :- WRIT - A No. - 20195 of 2023 Petitioner :- Sajjan Kumar Sharma Respondent :- Central Administrative Tribunal And 3 Others Counsel for Petitioner :- Saif Ali Counsel for Respondent :- A.S.G.I.,Pranjal Mehrotra Hon'ble Saumitra Dayal Singh,J. Hon'ble Shiv Shanker Prasad,J.
¶1Heard Sri Saif Ali, learned counsel for the petitioner and Sri Pranjal Mehrotra, learned counsel for the respondent nos.2 and 3.
¶2Present writ petition is directed against the order dated 30.03.2012 passed by the Central Administrative Tribunal, Lucknow Bench, Lucknow in Original Application No. 299 of 2008 (Sajjan Kumar Sharma Vs. Union of India & Ors.). By that order, the learned Tribunal has dismissed the Original Application and thus confirmed the order dated 08.04.2005 passed by the competent authority to reject the petitioner's claim for grant of compassionate appointment.
¶3Having heard learned counsel for the parties and having perused the record, we find, no good ground to offer any interference in exercise of judicial review inasmuch as it is undisputed, the petitioner's father 'Ram Bharosey' died on
07.08.2002. Arising from that unfortunate occurrence, the petitioner moved an application for grant of compassionate appointment on 27.08.2002. The same was rejected vide order dated 28.04.2005. Three years thereafter, the petitioner filed the Original Application. That itself was rejected on 30.03.2012. Almost twelve years have passed since then. The petitioner has survived for so long. There is no risk of destitution shown to have faced by him as may lead to any other conclusion being drawn by the learned Tribunal.
¶4Accordingly, both for reason of laches as also lack of merits, the present writ petition is dismissed. Order Date :- 13.12.2023 Abhilash . (Shiv Shanker Prasad, J.) (S. D. Singh, J.) High Court of Judicature at Allahabad
