¶1Heard learned counsel for the applicant, learned A.G.A. for the State of U.P./opposite party no.1 and perused the record.

¶2The instant application under Section 482 Cr.P.C. dated 21.09.2023 has been preferred by the applicant with a prayer to quash the charge sheet dated 04.04.2015, the cognizance order dated

26.04.2017 and proceeding of Criminal Case No. 4855 of 2017, arising out of Case Crime No. 242 of 2014, under Sections 419 & 420 I.P.C., Police Station-Bardah, District-Azamgarh, pending in the court of Additional Chief Judicial Magistrate, Court no.2, Azamgarh.

¶3In this case F.I.R. was lodged on 17.11.2014, which was challenged by the applicant in Criminal Misc. Writ Petition No. 22997 of 2014, in which interim protection was granted to the applicant vide order dated 11.12.2014, therefore, applicant was very much aware about this case. Considering the inordinate delay of about eight years in filing the instant application, I do not find any good ground to interfere in the matter.

¶4In view of the above, the application under Section 482 Cr.P.C. is, accordingly, dismissed on the ground of laches without entering into the merits of the case.
