¶1Supplementary affidavit, filed today, is taken on record.

¶2Heard learned counsel for the applicant and learned A.G.A for the State as also perused the record.

¶3This application under Section 482 Cr.P.C. has been filed seeking direction to the court below to decide the S.T. No. 224 of 2013 (State Vs. Manish Maurya and Others) relating to Criminal Case No. 439 of 2013 (Case Crime No. 172 of 2012) under Sections 302, 120-B I.P.C., P.S. Kandhrapur, District Azamgarh, pending before the Special Judge (E.C. Act) Azamgarh

¶4Counsel for the applicant submits that in para-3 of the supplementary affidavit, it is stated that court has examined prosecution witnesses upto P.W. 5 thereafter they are not proceeding with the case and proceeding was initiated in the year 2013. More than ten years have passed and the case is pending before the trial court.

¶5Considering the aforesaid facts, without expressing any opinion on the merits of the case, this application is finally disposed of with a direction to the court below to decide the aforesaid case in accordance with law, as expeditiously as possible, without granting any unnecessary or long adjournments to either of the parties, preferably within a period of one year from the date of production of a certified copy of this order, if there is no other legal impediment.
