Applicant has filed this application under Section 482 Code of Criminal Procedure with the prayer to expedite the proceedings of Complaint Case No. 1662 of 2018 (2035 of 2022); titled Santosh vs. Dinesh, under Section 138 Negotiable Instruments Act, 1881, Police Station Mungrabadshahpur, District Jaunpur pending before the Additional Chief Judicial Magistrate, Jaunpur within a stipulated period. Learned counsel for the applicant submits that the complaint relates to a summary trial which was instituted in the year 2018, wherein the accused has appeared only on 28th July, 2023 and has been released on bail. He prays that it would be in the interest of justice, if the trial proceedings are expedited as already nearly more than 5 years have elapsed. Considering the limited prayer, the nature of the offence as well as the trial, the application is disposed of with a direction to the trial court to expedite the proceedings by avoiding unnecessary adjourments.
