¶1Heard the counsel for the parties.

¶2The petition has been filed praying for the following relief: "To issue a writ, order or direction in the nature of mandamus directing the respondent no.2 i.e. District Magistrate, District Jaunpur to give the possession of the cutting trees in favour of petitioner, which is cutting by the respondent authorities."

¶3It transpires from the record that the proceedings regarding the rights of the petitioner have already been instituted before the Civil Court.

¶4In view of the aforesaid, the petitioner may file appropriate application before the concerned Civil Court and it is not a case for consideration by this Court under Article 226 of the Constitution of India.
