A personal affidavit is filed on behalf of respondent no.5-Mr. Yaduvansh Kumar, Sub Divisional Magistrate, Kayamganj, District Farrukhabad in the Court today, is taken on record. In compliance of the order dated 01.12.2023, Mr. Yaduvansh Kumar, Sub Divisional Magistrate, Kayamganj, District Farrukhabad is present. He submits that under some wrong impression the aforesaid order was passed and apologizes for the same. The reasons given in the affidavit for such mistake being committed by him, which are not deliberate, is satisfactory. He has also restored the fair price shop of the petitioner, which is admitted by learned counsel for the petitioner in the Court. The personal appearance of respondent no.5 i.e. Mr. Yaduvansh Kumar, Sub Divisional Magistrate, Kayamganj, District Farrukhabad, is exempted. Accordingly, the present petition is dismissed as infructuous, as nothing remains in the petition.
