¶1Heard learned counsel for the applicant as well as learned A.G.A. for the State of U.P./opposite party no.1.

¶2The matter relates to offence under SC/ST Act.

¶3At the outset, learned A.G.A. representing the State as well as learned counsel for opposite party no.2 raised a preliminary objection that in view of Section 14A of SC/ST Act, instant application under Section 482 Cr.P.C. is not maintainable.

¶4In response, learned counsel for the applicant submits that he does not want to press this application, therefore, the same may be dismissed as withdrawn with liberty to file appeal under Section 14A SC/ST Act.

¶5Learned A.G.A. representing the State as well as learned counsel for opposite party no.2 have no objection to such prayer of learned counsel for the applicant.
