The petitioner claims to be Lab Technician appointed at Primary Health Centre, Sakrauli, district Etah under the National Health Mission and yet he has been transferred to a different Health Centre. He submits that the National Health Mission appoints the employee for particular place and cannot be transferred to other place as their contract appointment is to serve in respect of place concerned. He submits in this regard controversy has already stood settled by this Court in Writ A No. 1275 of 2023. Learned Standing Counsel could not dispute the aforesaid. In view of above, this petition also stand disposed of in terms of order passed by this Court in Writ A No. 12725 of 2023 and accordingly, order impugned of transfer dated 22nd/ 30th April, 2023 is hereby quashed.
