Judgment
Court No. - 34 Case :- WRIT - A No. - 20592 of 2023 Petitioner :- Vikash Singh Respondent :- State Of U.P. And 3 Others Counsel for Petitioner :- Ranjeet Kumar Mishra Counsel for Respondent :- C.S.C. Hon'ble Ajit Kumar,J. The petitioner has admittedly raised industrial dispute with regard to illegal retrenchment done on 30th September, 2021 while his matter was pending before the competent authority for the purpose of absorption /regularization vide dispute no. CBA-D2/2021. He submits that there is direction issued on
12.09.2022 to maintain status quo. Be that as it may, since petitioner has already raised industrial dispute if he is not permitted to discharge his duty, should pursue his dispute before labour court. In so far as direction contained under the order dated 12.09.2022 is concerned, it is merely order of status quo whatever status was existing as on 12.09.2022 would continue. The petitioner may seek further relief before Assistant Labour Commissioner and the relevant committee formed for the purpose of resolution of labour dispute under the relevant clause of the Industrial Dispute Act.. This Court does not find any good ground to grant indulgence in the matter of industrial dispute. Petition is accordingly consigned to records.
