¶1Heard Counsel for the parties.

¶2In compliance of the order of this Court, instruction dated 13.12.2023 is placed before this Court, which is taken on record.

¶3Mr. Om Prakash Sharma, learned Additional Chief Standing Counsel for the State-respondents, on the basis of instructions, submitted that plot No.231 sa area 0.1260 Hectare is recorded as Garhai in the revenue record. He further submitted that in the spot inspection, it has been found that aforementioned plot has been encroached by the private party regarding which the proceeding u/s 67(1) of the U.P. Revenue Code, 2006 has been registered as Case No.T202317140310864 in which 22.12.2023 is date fixed for hearing.

¶4Counsel for the petitioner submitted that appropriate direction be issued for the disposal of aforementioned case.

¶5Considering the facts and circumstances, the instant public interest litigation is finally disposed of with a direction to respondent No.3 - Tehsildar, Tehsil Basti, District - Basti to decide the aforementioned case after affording opportunity of hearing to the concerned parties, expeditiously, preferably within a period of three months from the date of production of a certified copy of this order.
