Hon'ble Ajit Kumar,J. The petitioner claims to be working on Group-D post with respondent department since last 10 years and therefore, claims that he should be given at-least minimum of wages prescribed under the Government Order as admittedly horticulture department is State department. He submits that State cannot discriminate in the matter of payment of minimum wages more especially when he has been discharging his duties for last 10 years as a gardener. He further submits that gardener has very important role to play in the horticulture department and therefore, he is entitled to be paid at least minimum wages prescribed under the Minimum Wages Act, 1948 and Rules framed by the State Government in that regard. In such view of the matter, this petition at this stage stands disposed of in the event petitioner raises such plea by making representation within four weeks from today, the same shall be accorded due consideration by the competent respondent namely, respondent no. 4 and same shall be disposed of within a further period of four weeks.
