1.Heard learned counsel for the petitioner, Mr. Shridhar Tripathi, learned Standing Counsel for the petitioner and Mr. Sudhir Bharti, learned counsel for respondent No.5/Land Management Committee.

2.In compliance of the earlier order of this Court, instruction dated

11.12.2023 is placed before this Court, which is taken on record.

¶3Mr. Shridhar Tripathi, learned Standing Counsel for the State-respondents on the basis of the instruction submitted that plot Nos.810 and 405 area 0.028 hectare is recorded as 'Garhi' in the revenue record. He further submitted that demarcation has been made of the plot in dispute and it has been found that respondent No.6 is in possession accordingly Case No. T 202305470113174 under Section 67 (1) of U.P. Revenue Code, 2006 has been registered against the respondent No.6 and next date fixed in the matter is 19.12.02023.

¶4In view of the facts mentioned in the instruction as well as considering the facts and circumstances of the case, the instant Public Interest Litigation stands disposed of finally with a direction to respondent No.4/ Tehsildar, Tehsil-Sadar, district-Maharajganj to consider and decide the aforementioned case in accordance with law expeditiously and preferably within a period of three months from the date of production of certified copy of this order after giving opportunity of hearing to the parties concerned and without granting unnecessary adjournments to either of the parties.
